The statement indicates that she sent Secretaries Rice and Chertoff letters asking them to reconsider any mid-month updates of the July Visa Bulletin. As people know, she is the powerful Chairwoman of the House Judiciary Committee Immigration Subcommittee. Her statement is very important in two areas. One is the political attention we desperately need. The other is potential impact on the House action on employment-based immigration legislation as impacted by the incidents.     They are requiring them to transfer from L1 to H1 status for L1 extensions. This will also mean an opportunity for them to move on to better paying companies and green card sponsoring companies, when they get a H1B status. A list of well paying and greencard sponsoring companies can be found by googling for "h1b unsweatshop"

    You effing ahole.. Are you following any news lately? See how many states are trying to take criminal action against those who made such loans falsifying the documents. The ones who "made" the loans collaboarted with the borrower to bring up stated income.

    If you always "do the rght thing", for your way looking down on all others , you should go kill yourself. That is the right thing to do for the way you live without compassion, not being able to make an argument without calling names, death for you is the right thing. So, tell me how is that "right thing" coming along.

    Do some introspection and tell me that you never done a wrong thing in your life. Then we can discuss further, if you are ready to have a civil discussion without calling names.

    FYI, I haven't done what the original poster is being flamed for , but I understand why he may have done that.


    Don't confuse between taking legal risk with doing something illegal. You must be an idiot to think they are the same.

    Poeple that sold $500K home to those who make $40K were not doing anything illegal. What they were doing was irresponsible. It is the guy that was making $40K, but lied on his application that he was making $80K that is the criminal.

    And your assumption is that we are complaining about unethical behavior because we are in the US and we think that everyone in the US is ethical? How stupid are you? Sorry to burst your bubble, but we do not think so. I, and many like me, think we should do the right thing no matter where we are, here, India, or elsewhere.

    Dear Mehul...

    I wish and pray that God gives strength to you and your family in this difficult situation. And as fellow IV'ns have mentioned, Prayer and Faith in Life/Almighty can do wonders. By the attitude in your note, I do feel you have that ... and somehow I have a feeling things will be fine for you and your family.

    As suggested by many people, if possible, please do get a 2nd opinion from a renowned doctor in India. And do start Yoga/Pranayam. Meditation and proper breathing exercise have helped folks with very serious conditions and these are surely worth trying.

    And for your GC, I would second the suggestions of writing to senator and USCIS.

    Your family should be your reason to continue to have faith and NOT give up...

    Heartfelt wishes and prayers with you... Always !!!

    Those that matter and can make a decision will ask just one question.
    "If oldest priority date should be considered then what is the use of categories like EB1, EB2, EB3 etc." ? It is a weak argument to say that we are talking only about spillover visas here.

    Why, indeed, should USCIS give spillover away to anyone? They could as well sell off the excess visas at a premium, can't they?

    No one's trying to cut the line here. If there's any, it's purely procedural and has nothing to do with 'Ending Retrogression'. With or without retrogression someone might get an RFE, get stuck in namecheck etc. Ending retrogression provides earlier PDs better chances of getting GC faster (if dates are 'C' you get it the month you clear RFE, Name check etc.)

    Just posting here isn't helping you cause. Instead you guys can get together and start sending flowers to USCIS director requesting him to publish the complete list of GC applications approved every year. It's the first step in enforcing FIFO. Right now there is no such list and no way of knowing who got their GC out of turn. And while you guys are at it also send some flowers to FBI to clear Namechecks FIFO, to DOL to approve PERM petitions FIFO etc.

    Go spend those $50 at Flowers.com folks. Start writing to Senators, collect money, do the lobbying etc. Who's stopping you?

    Or do you want logiclife, pappu and rest of the IV core to do it PRO BONO for you?

    I'm a july filer (July 16th)
    have gotten EAD
    Case status online says AP approved on Nov 2nd.
    But NO FP.
    Opened a SR on Oct 19th but don't have an appointment.
    Called again yesterday and was told to call back on Nov 19th if I still don't have FP appointment.
    Of the 6 filers at my job, only 2 got FP...very strange.
    FYI, when I called the USCIS, they said it is very unusual not to get FP right after receipt notices. Apparently, the FP appointments are sent "automatically" after the receipts are generated/sent etc. That's what the USCIS rep told me anyways and she opened a SR on her own based on the info I gave her that my FP appointment hadn't arrived after over 100 days.

    I asked my employer if they would tune the clauses to "1 yr after EAD" but they said NO - "it will be 1 yr after GC"

    They also told me over phone that they have the capability of revoking
    140 and complaining against me to INS if i try to leave before getting the actual GC.

    Can they do that - after 6 months they lose that control - Right ??

    Employer can revoke I-140 anytime until I-485 is approved. After 180 calendar days of I-485 filing date, employee can continue I-485 seeking AC-21 protection . Employee must have open permanent job offer from another employer. The new job must be same or similar.

    LoL. He is not even aware of the law. Employee is required join AFTER getting the green card, not before.

    Even after 180 days, your employer put a withdrawal request with proof of insufficient financial strength to pay you from the period start (within 180 days ) till the withdrawal request date then what will you do? Now it is clearly "un approvable" during "even within 180 days" . Now 180 days passed already? - yes. I-140 is already approved? - No, Employer filed withdrawal ?- yes? Employer shows underlying reason of insufficient finance capacity within 180 days - yes .. Then case closed - Denial - Next.

    Above argument is not fully correct. Someone had posted extracts from the law. Please read that once again, and keep in mind the spirit of the law as well.

    Until 180 days: If I-140 is denied or withdrawn, no GC. Note that you are not required to be working for sponsoring employer prior to your getting GC. There should be only an intent on both parties to establish employee/employer relationship upon getting GC
    After 180 days: I-140 withdrawl has no effect provided beneficiary (you) has another job offer for the same/similar job. No new I-140 needed, if first I-140 was approvable.
    I-140 denied after 180 days: No GC if still with same employer. If new employer (for same/simiar job), new I-140 is needed. If different job new LC and I-140 (keep original PD)

    Bottomline is that there has to be at least one I-140 approved at some stage.

    Thats not true. My PD is March 2005. When my PD comes, I have to apply for EAD whereas others will get GC. Oh such a screwed up system.

    It is true. I will take a bet. If your PD does not go to March 2005 by Sep 2009, I will give you $100. It it goes give me $100:D

    I was confident on this before, you have just made me super confident.

    I have been saying all along that one can get a same/similar job after 180 days irrespective of the whether I-140 was approved or not. I don't know why some people / lawyers spread so much mis-information on this topic.

    But please, just trying to beat around the bush is not going to help anyone here for that matter not just me alone. You suggestion of sending flowers seems like that is the only solution to all the problems. I would say the reversal of the July 2 visa bulletine didn't just happen because of the flowers the members sent, the law suit AILA wanted to file against USCIS was one of the major reason apart from the California's Lawmakers letter. So please don't try to cut peoples idea by trying to belittle them, if you don't agree with them it is ok, if everyone agreed on the same thing life will be so dull.

    Your post is highly misinformed and members aren't surprised by your lack of correct information, you mention in your profile that you don't want to volunteer and you didn't attend the DC rally. No wonder you are disconnected from reality about how far IV has come. It is a fact and all members know this, IV scooped the July visa reversal news.

    Please stop living in the blunderland and face the reality. IV was a big reason, we never clam to be the sole reason. We work with other stakeholders. Without a grassroot effort none of the other constituents would have been effective. You mention about the AILA lawsuit "threat," well, why didn't they actually file the lawsuit? We agree that the lawmaker's letter was instrumental in the July visa fiasco reversal. We had an unprecedented San Jose rally by legal immigrants.

    You need to get serious and need to contact your state chapter leader to get some more information about IV.
    Stop misinforming others! It is about time IVers realized their infuence and exploit their full potential. Don't let such misinformed comments affect your efforts.
