Hi Gurus,
I have couple of questions regarding my AC21 portability, please post your thoughts on this.
My I485 was filed in July, 2007 based on approved I140 (EB3 India). Now I have new approved EB2 PERM labor from same company and I am also working for the same GC sponsor company and planning to interfile to my existing I485 so that I can capture old PD in to EB2. My question is,
1) Can I invoke AC21 immediately after interfiling or do I need to wait another 6 months after interfiling?
2) Will there be any impact on my old I485 application in case of interfiling denial?

Call up your local public radio station and tell them about this event (http://www.npr.org/stations/)
Any other ideas regarding increasing the visibility of this campaign should be posted on this thread.
I would try to contact FM 104.9 and AM 700 in Dallas both radio stations are delivering programs in Hindi and Urdu and to the extent very popular in SOuth Assian community. I would update here about my efforts.

We have explained you during the phone conversation that it is not the right time to pick up country limits issue. We have run this by our strategist again and they have also advised us that its not the right time for this issue. Others on the forum, including unitednations, have also made an attempt to explain you the issues we are all dealing with. You are free to do whatever you think is best for you. We think that your actions are likely to harm the community effort. I think the threat of "ban" is out of place for mirage. Even if you ban his user id, he can pursue with his agenda irrespective of whether he is banned or not. IV core should educate mirage and other focus group leaders than threatening to ban them.

In addition to completing the action item, set up an appointment with my Congressman for the week after next to push for this provision.
As stated by the more experienced folks involved with this initiative, the bottomline is that any action item should be accompanied by a grass roots effort where all our members should meet with the local congressmen/congresswoman to push for our provisions (in this case visa recapture). Coordinated action items and phone campaigns always help but we should not wait for an action item to talk to the lawmaker offices in our local districts.
As stated by the more experienced folks involved with this initiative, the bottomline is that any action item should be accompanied by a grass roots effort where all our members should meet with the local congressmen/congresswoman to push for our provisions (in this case visa recapture). For any lawsuit, there needs to be a basis. What is the basis of your proposed lawsuit?
It has been standard operating procedure to process applications on a FIFO basis, subject to some granularity. People who feel they should get their GCs first because their PDs are older are sadly mistaken. Processing by USCIS is based on RD/ND. Not PD. So any lawsuit complaining about PD-FIFOs is not going to fly.
I highly doubt that any lawsuit which complains that NSC is slower than TSCs is not going to fly either. Each Service center has certain amount of staff, and allocation to jobs, they will be some discrepancy. If someone is able to make a lawsuit stick on this basis, let us know, we will build a avalanche of lawsuits because labor was not being approved in an orderly fashion in 2001-2004 time frame, all of which will then have a direct impact on all the 2004-2006 filers.
Go ahead and help us out. File your lawsuits, EB3s will join the party with our own lawsuits.

Wait for a couple of more weeks-- It is on the way. Don't go by the dates USCIS posted. They apparently don't correctly reflect the actual.
i sent application for me and my wife on july 6th NSC my I 140 was applied in TSC . i am NJ resident. wife took info pass appointmnet as no check cashed, no notice receive. started worrying now. as NSC is updating even new applications no sure if my case was transferred to TSC or not . any body in same boat ? application was signed by R williams in NSC.

Brother your assumption is flawed if someone come under reservation category they get their guaranteed reservation seat (on their merit basis in that class) if reservation % is fulfilled as per rule then their application goes to open category. That means 50% resources is for everyone in India.
This was happened few years back to get admission in one of top Medical school after scoring more than 92% was not able to get to desired top medical school but one of his friend who had just scored 58% was able to get in top notch medical school. Now this remind me similar situation what was happened 50 years before. Now making matter worst student who had got 92% was belonging to very middle class or you can say poor family but his friend was belonging to class one gazetted officer�s family (I would classify them upper middle class).
I think reservation was required in past to up-lift backward class and give them justice in system but now situation is change drastically we see people from all class is on same page .if someone wants to argue on this that is fine. In real sense if we need reservation then it should be on economics basis everyone should file taxes and they should get reservation accordingly with merits .In this way government will get more revenue and on the whole we will have fair justice to everyone (all cast )and this will provide better visibility what is happening to normal families. Now some will debate how we can avoid fraud for reporting low income then hey that is what government should be doing, proving infrastructure and enforcing rule of law other than that government has no business in dictating which cast is upper cast or lower cast.
Now real question pose by the other users here are we better-off here or back home? I think we always indulge in material benefits but there are other aspect of life you cannot put face value on it .What matter is the most are you Happy? What is your ultimate goal of life? What is the most important thing you want to have in your life? What is the most irritating thing you cannot overlook or make you uncomfortable? On top of all these key questions what are tools /resources available to you to address all these likes dislikes. So let us say if you are shooting for quality life then define what must have for that life and to get those you may have to bite bullet and compromise on some of those. If you can find middle ground some where there then we call those people happy people or successful people. So life is about making right choice all the time as per your own situations. When we are in this fine-tuning process we can always use help from our resources, friends, relative, culture, God, Money and our own intellectual.

Well.. may be that's the dose of reality core team needs to give to its members and that may wake up non-contributing, non-helping, and just log in to check status type of members. Just come out and say that we are too small of a group with very limited resources and influence on the capitol hill and we can't get any of our goals including non-controversial ones passed unless we have at least XXX number of members and X dollars in contribution. At least this will set the facts straight and members won't have a false expectation on some of these non-controversial measures.
Once that is clear, may be folks who are staying back or hesitating in terms of either contributing or supporting IV in membership increase will realize that it's either time to act or preserve the status quo.
All I am saying is that may be we should make the reality on the ground and rules of engagement clear to all members/non-members so that they can all set only a reasonable amount of expectation from IV under the circumstances unless something drastically changes like the membership or the contribution.
So far, we have piggy-backed on CIR and SKIL both of which were to a large extent driven by corporate interest. If you take these realities into consideration, provisions like 485 etc are not low hanging fruits any more, because we no longer have a stool to stand on. Given the infamous intertia of the lawmakers, introducing our own independent provisions will take a lot more than a membership base of around 6-7K, a contributing base of around 2k and a free-riding/blissfully ignorant base of 900k+.
Unless we become a truly representative organisation of prospective EB immigrants, we cannot take on the combined might of the anti-immigrants and the H1 thristy corporates. Not to be negative, just giving an alternate opinion.

I think we have a provable point as per the USCIS CSR msg "We approve all cases based on the order they are received". So basically it says Approval based on ND. Approving Oct'07 NDs and not approving (not even touching) Jul-Sep NDs makes a valid point.
I am not sure how to put our case based on PD because to me PD serves the purpose of passport to get in and then line is formed by ND. But sure, if anyone could put some thoughts and define the situation, I think its well worth to try something different now.

Is there premium for I485?
I am not a lawyer but as far as I know there is no Premium for 485. They mentioned they will want to do it at some point in the future but it is not yet available for this application.

having been in the US since 2001, losing out my LC/PD to the dot-com bust and finally ending up with a PD of 2006, I second that. PD should be based on number of years of experience or years of stay in the US or amount of taxes paid till now or something like that.
In any case what we WANT is very different from what we usually get from this immigration system and there are bigger more important battles for IV to fight. Look, if there is no retrogression PD almost does not matter!! THATS the right fix. END RETROGRESSION!
Being a 2001 PD myself I fully sympathize with you for your trauma and support your notion that the Immigration System should give weightage to the number of years in the US, I do not support the notion of ending retrogression. Given that there are only a finite number of visa quotas, ending retrogression will make the GC a game of Inky-Pinky-Ponky. Either they give it to everyone (all the 800000 that applied) or they do FIFO based on date of entry in the US. If not, the present system of retrogression at least ensures that a person who came into the US in 2007 does not win the Inky-Pinki-Ponky game before a person like me in the queue since 2001. In any case what we WANT is very different from what we usually get from this immigration system and there are bigger more important battles for IV to fight. Look, if there is no retrogression PD almost does not matter!! THATS the right fix. END RETROGRESSION!
Being a 2001 PD myself I fully sympathize with you for your trauma and support your notion that the Immigration System should give weightage to the number of years in the US, I do not support the notion of ending retrogression. Given that there are only a finite number of visa quotas, ending retrogression will make the GC a game of Inky-Pinky-Ponky. Either they give it to everyone (all the 800000 that applied) or they do FIFO based on date of entry in the US. If not, the present system of retrogression at least ensures that a person who came into the US in 2007 does not win the Inky-Pinki-Ponky game before a person like me in the queue since 2001. What has been your contribution so far (not just monetary but otherwise?). Why don't you lead an effort and be the one which shows some leadership so that we all EB3's can follow you?
I guess you have an EAD and AP but instead of going into the details of what role IV played to get us to that stage you can just spit BS over here.
I am sure you have read Pappu's post a few times, next time just see what his category is.

In my opinion, we need to have separate efforts for EB3 (now that EB3 I and EB3 ROW are in the same boat). If we have someone with leadership qualities and wants to use some social networking site for discussing EB3 issues and identifying approaches to solve the EB3 issues, there will be many EB3 folks willing to support the effort. Immivoice is just useless portal, it doesn't have open forums and the core folks here don't care for EB3. In fact, their lobbying efforts were behind USCIS changing the rule for spilling over the unused visa numbers to EB2 first. Just my 2 cents.
