Hi Prem,
Your sister will certainly be subject to greater scrutiny if she returns immediately to the US after an extended stay. Whether she is is ultimately admitted to the US or denied admission and sent back home really depends on several factors. First, can your sister persuasively demonstrate that she has strong ties to her home in India, to which she intends to return at the conclusion of her business trip? Next, can she document that she will be engaged in permissible B-1 activities of limited duration? And finally, on what side of the bed did the CBE officer wake up?

Based on current estimates, it will be 10-15 years time, unless u r son/daughter can sponsor you prior... u will end up in family quota wait still.
I am not sarcastic this is the reality,
There are many people on this forum who have been waiting for 5 years or more. No one can predict when you will get the GC- such is the beauty of the EB Immigration System.

1. Yes there is shortcut. Join desi software company. You will get forged diplomas.
2/3. Not applicable. Refer 1 above
4. Current job market is great. Obama is going to reverse outsourcing. All software job from India & china will come back to USA. But for china return job you need to know some mandarin. But no certificate needed refer 1. Above
5. I made such a transition recently I was mortgage securities bundler at lehman bros. Now I am successful engineer
6. Salaries start at around 150k per year even in places like north Dakota. But since engineers understand log scale, salaries grow exponentially
Hope this helps

CHC speaks only for illegals...
they fear any partial immigration reforms will harm their political constituents..namely the hispanic voter base.
They will never come onboard for legals..we have to fight our own battle.
So individual constituents on this forums can have personal views..
As far as I know we HAVE NO STAND on the issue.
Our goal is simple, to seperate ourselves from "undocumented immigrants", we do not call it "illegal immigration" as per our initial IV discussions.
IV stands as an organization for Employment Based Legal Immigration and nothing BUT that. So, again, in short we HAVE no stand on "illegal immigration".

RFE is basically 'looking for proof /more information'
Wait for that then you'll know what they are looking for
-and lately 'anything' is very normal :(

All,
Please let me know your suggestion based on your experience.
H1B Details
H1B Entry in USA: 25-Mar-2007
Applied for Extension: 16 Dec 2008
RFE Received: April 2009
RFE Responded: May 2009
Denial Notice in USCIS Online System: 14-Sep-2009
VISA & I-94 Expired: 25-May-2009
Clarifications
1. Can I apply for the H1B Transfer with another Company ? I got a offer from a Company and they would like to do the H1B transfer and they are stating that there are no issues for H1B Transfer though the Extension got denied.
2.Since the H1B Denied, From When I have to stop working ? Is it after i receive my denial documents?
4. If transfer is possible, Can I start working based on the H1B Transfer Receipt Notice ? or Should I wait for the H1B Transfer Approval Notice to work ?
Please let me know your suggestion based on your experience.

This seems to be a new requirement specificed by the consulate.
I havent seen any prespecified format of this letter. But it should contain as much information as possible about your past employment. Some key points would be

A. Since the law is unclear, to be on the safe side, you can have the new company file H1 extension in premium processing and resign/leave the current employer only after extension is approved
B. Yes, new company can start a new PERM and port your earlier PD during I-140 process
C. PD can be ported even if old employer revokes I-140, provided the revocation was not due to fraud.
Also, I am sure all IV members would really appreciate if you could tell us the name of this company which is offering a life long stability..:-)
roseball & "meridiani.planum" thanks to both of you on this confirmation. I will make sure to resign only after getting 3 years approval by new company.
roseball, "life long stability" is relative term as I am seeing new job much more stable than where I am as of today. ..
Again thanks for your help..

If one transfers H1 after I140 approval, employers should have no reason to withdraw the I140. Unless ofcourse for revenge :)
Right now, a lot of big companies withdraw I140 and reuse the labor for another applicant. With the new law in place, employers have no motivation to withdraw the I140.
Yeah..
In fact the act of withdrawing also costs money which many employers would not be willing to pay...
Good one....Never thought of it this way...

I saw some postings about AP wherein people got 3 AP papers.
Is it ok if you just get 2 AP papers?
Thank you.

If you have worked on location other than what's mentioned in the certified LCA, it will be considered as an unauthorized employment, eventually application for adjustment of status will be denied on the basis of you engaged in unauthorized employment.
Thank you for this comment. I wanted to respond with something similar but held back thinking that if even by small chance this guy is real I do not want to upset him. But the fact that he simply did not respond to you speaks volumes of his real intentions.

I am also in the same boat. If the current employer does not like me to move to a new position, is there anything the current employer can do stop getting GC?
My I-140 approved and I-485 is pending more than 180 days and priority date is Aug 2004 (EB3).
I got a good offer and want to leave the current employer by shifting to EAD from H1. What would be the worst case scenario the present employer can do to stop getting GC or what else I might need from him in the future regarding GC processing?
Gurus, please help.

'Cautious Optimism' are the key words folks ;)
-- as some else put it in another post .. this has not cured us of the retrogression ailment, this is just a pain killer.
We should move ahead as planned. My support for IV core as usual.

Hello
My PD is March 2006 and my 6th year on H1B ends in March 2007. My LC was approved in March 2006 and I-140 got approved in July 2006. My company has relocated me to a different state. (same job, same title and company)
I have updated INS about my address change by sending AR-11. Would the job location change (from CA to NJ) have any impact on my GC processing?
Could you please advice if you info on this?
Regards
